Tier 4 visa can i work

The University of Leicester offers many volunteering opportunities. If you wish to participate but are still unsure please contact volunteering le. The University considers that working more than 15 hours per week is detrimental to undergraduate or postgraduate students studying on taught courses and Senate Regulation 4.

Some students depending on their mode of funding some grants will not be permitted to work additional hours which is why permission must be granted by the department. The slightly different wording of the Senate Regulations does permit work of up to 20 hours but students are expected to prioritise their studies and carefully consider the impact work will have on them. All students undertaking part-time work should note it will not be accepted as as a mitigating circumstance to excuse absence or poor academic performance.

It is important to note that some jobs in the 'gig economy' may be classed as 'self-employed' and therefore in breach of your visa and not allowed , e. O ccasional selling on Ebay is within the rules and permitted.

If you are in doubt please contact visas le. Most students on a Student visa or Tier 4 visa have immigration permission that starts up to one month before the course start date and extends for up to four months beyond the end of their studies.

If you are allowed to work, you can work before your course starts and after it ends according to the dates on your Certificate of Acceptance of Studies CAS. You can also work full time during your vacations. If you want to work more than your usual restricted hours, your employer is required by law to check that your education provider agrees that you are on holiday.

Your holiday entitlement is determined by your level of study. These are published on our website for your employer to check. PGT students studying Maths, Engineering or Informatics who began their course in January are entitled to the summer holiday in their first year of study and are permitted to work full time during this period. These courses are longer overall than those of other postgraduate students to allow for this holiday. It is only the summer vacation in the first year students are entitled to as in other academic years they will be working on projects or out on work placements.

If you stop studying we will withdraw sponsorship and notify the Home Office. Any permission to work that you have will expire on the new date that your permission will expire following curtailment. Curtailment can be with immediate effect or take effect 60 days from the date you were notified that your leave was curtailed. If you defer part of your studies to later in the year perhaps because of the impact of covid or for other personal or academic reasons the end date of your programme of study will change and so will your working entitlement.

As you may be completing a project or exams during the published summer vacation period you are likely to be classed as remaining in 'term-time' and your working restrictions as above will remain in place. You should immediately inform your employer of any change in your circumstances, and if they are unsure whether you still have the right to work, they should contact the Employer Checking Service. Your student visa does not permit you to engage in business activity.

The Home Office defines this as working for a business in which you have a financial or other significant beneficial interest in a capacity other than as an employee. However, this is not an exhaustive list. If you are unsure whether this restriction would apply in particular circumstances, you should seek further guidance from the International Student Office prior to undertaking the activity. Undergraduate students are able to undertake an internship during the official University vacation periods.

The employer will need evidence of the academic calendar as confirmation of the vacation dates when you are permitted to work full-time. Medical students undertake work placements as part of their course and the International Student Office provides details of these placements to the Home Office at the beginning of the relevant academic year.

Masters students are able to undertake an internship during the official vacation periods. These dates will vary depending on the course so you should consult your Faculty and Department for further details regarding the official vacation periods. A small number of Masters courses include the option of a short internship as part of the course. If this applies to your course it will be included in the course handbook.

As an embedded part of the course, this is permitted on a student visa but the International Student Office will need to provide the internship details to the Home Office in advance so it is important that you keep your Faculty or Department informed of any changes. The academic year for postgraduate research students is continuous throughout the year. This means it is only possible to undertake an internship on a student visa if it is considered to be contributing to your PhD research and approved under the leave to work away procedures.

Whilst breaks for holidays are permitted, at times agreed with your supervisor, these periods are not to be used for full-time work. If you wish to intermit in order to undertake an internship, it will not be possible for the University to continue to sponsor your visa during that time and the internship could not be undertaken on your student visa.

Unless you have switched to an alternative visa that permits study, you would be required to apply for a new student visa to resume your studies after the intermission period ends.

Whether you can undertake an internship after submission of your thesis for examination varies depending on the stage of the process as outlined below. You can volunteer on your student visa but the Home Office makes a distinction between volunteering and voluntary work.

Even if the opportunity is advertised as 'volunteering', it could still be considered voluntary work. The Home Office advises taking the following into consideration to help determine if it is voluntary work or volunteering:.

The worker is usually remunerated in kind. It is advisable to check with the organisation offering the volunteering opportunity whether it would be regarded as unpaid employment. The restrictions on the type of work you can undertake on a student visa, as outlined above, continue to apply. After your course has ended and whilst your visa remains valid, the Home Office allows you to work full-time.

The restrictions on the type of work, as outlined above, continue to apply. This information is of relevance to you if you are allowed to work during and outside term time, not if your work permission is limited to work placements. Most Students and Child students have immigration permission that extends beyond the end of their studies.

You can work full time for this extra period once you have completed your course, but you may not be able to work at all if you have not finished your course.

There are some exceptions from the usual restrictions if you make an immigration application to 'switch' into a work route. Once you have completed your course and are no longer in term time, you may work full time though usually not in a permanent post , leave and re-enter the UK and make further immigration applications.

If you travel during this post-study period, Border Force officials will need to be satisfied when you are entering the UK that you will either.

You should carry any relevant documents with you when you travel to show to the Border Force officer if required. This is particularly important for you if you want to stay in the UK as a Student or if you want to make an application in a work category.

Alternatively, you might choose to make your next immigration application in the UK before you leave, or while you are outside the UK. This means that on re-entry your immigration permission will match your intentions and you are less likely to have to answer questions about your plans. If you complete your course earlier than the course end date on your confirmation of acceptance for studies CAS , your student sponsor is obliged to report early completion to the Home Office.

If you have more than 60 days' permission when your early completion is reported, the Home Office will contact you to let you know that your immigration permission will be cut short cancelled. Permission is usually cancelled to the new end date plus the additional period you were originally granted, for example one month, two or four months after the new end date.

You can work between the new end date of your course and the new expiry date of your immigration permission. Employers need to see confirmation from your university or college that you have now completed your course. If at the end of your course you apply to stay in the UK under a work route, you can usually work full time until your work application is decided. Normally, you must not take work that your work condition prohibits. You can start your Skilled Worker job up to three months before your course end date, but no earlier.

This means that if you apply for Skilled Worker permission after 12 months of study towards a doctorate, you will usually need to wait for a decision before starting the job. Similarly, if you have applied under the Start-up route, you can start your business before you receive a decision from the Home Office on your application.

This does not apply to you if you are waiting for a decision on a Graduate route application. Your Graduate permission must be granted before you can start a permanent job, self-employment or work as an entertainer. You are not permitted to work as a professional sportperson even after you have been granted Graduate permission. You might have Student immigration permission that allows you to work, but you leave your course or take a break from it before you have completed it.

This includes the situation where your student sponsor withdraws sponsorship temporarily because you need to re-sit exams or repeat some of your course and do not need to be in the UK before you re-sit or repeat, or your sponsor might lose its licence.

In these situations, the Home Office will usually cancel curtail your permission so it ends earlier. The Home Office publication, An employer's guide to right to work checks states that you may continue working until the new end date of your cancelled Tier 4 or Student permission.

For full details of when employers may and may not employ you in these and similar circumstances, see information under the heading, 'Impact of a change of circumstances on a student's right to work' in the Home Office publication, An employer's guide to right to work checks. Note that your immigration permission should not be cancelled if you are unable to study for a reason related to Covid If your study is suspended by your sponsor for a Covidrelated reason, you are permitted to work full time during this time.

Suspension means your course is not taking place for a temporary period; it does not include time when you should be studying online. For details, see Guidance for Student sponsors, migrants and short-term students on temporary concessions in response to the outbreak of coronavirus. At present, all students in the UK should be studying in person, online or a blend of both, so it is unlikely that this concession will apply to you now.

If you have work permission, make sure that you do not breach its requirements. Even if you are no longer able to attend classes or undertake research in person, if you are in term time, and you are studying online, you are still restricted to working 10 hours a week, or 20 hours a week, depending on the level of your course.

You may work full time outside term time. Vacation dates have not changed just because you are not attending classes and lectures in person. If your course of study has been suspended, you are treated for work purposes as if you are on vacation, so may work full time.

Employers should not employ you full time unless your education provider confirms that you are outside term time including suspension of study, which means you are not studying your course online , or are undertaking a work placement as an assessed part of your course. If you are unable to study or take a work placement for a COVID-related reason, your student sponsor should not report you to the Home Office, so your immigration permission should remain in place and not be cancelled.

However, if you complete your course early because of not taking a work placement, your student sponsor will report early completion to the Home Office. In this situation, you should expect your immigration permission to be cancelled and, if possible, prepare to leave the UK or make another immigration application.

If you lose your job because of workplace closures, you can apply for other jobs, though it might be difficult. Some employers are recruiting additional staff to deal with changes in their way of working - see Finding work.

The special schemes that the UK Government created to prevent hardship for employees and self-employed people, including the furlough scheme, were not 'public funds', but they are no longer available.
